CPSIA Restrictions on FBA Inventory

Below is part of an email that i got from Amazon.   I got the November letter

but  i have no record of the Feb letter.  How can I check to see what if any products  does not compey with  the CPSIA

Dear FBA Merchant,

We are writing to inform you of further actions that Amazon is taking in response to  the new lead and phthalate limits set by the Consumer Product Safety Improvement Act of 2008 (“CPSIA”).  Please review the options below, as these actions may impact your FBA products.

We previously advised all sellers on our platform (though a November 11, 2008 email with subject line “ACTION REQUIRED:  New Safety Legislation for Children’s Products”) to familiarize themselves with the provisions of the CPSIA and to prepare for the entry into force of the new lead and phthalate limits.  These limits took effect on February 10, 2009 and apply to the sale of applicable children’s products, regardless of the date of manufacture.   

In February, 2009, we informed you that Amazon.com as a retailer had restricted certain products for sale in response to CPSIA and that you own products stored in our fulfillment centers through the FBA program that are the same as those restricted products.  At that time, we asked you to take appropriate action to comply with CPSIA – either by removing any non-compliant products from your inventory or by providing us documentation from the product manufacturer demonstrating that your products are compliant.

As a next step, effective March 14, 2009, we plan to discontinue listing those FBA products that remain in inventory and for which we have not received such documentation. As an FBA

Amazon will kill the listings themselves.  One would assume the SKU will still be listed in the Inventory Amazon Fulfills section with the warning message "No listings exist for this item".  Hopefully Amazon will allow you to create a removal order for any items that don't comply.

Hi worldtoys,

The February letter referred to in the e-mail went to FBA merchants who had inventory that was identified as restricted because of CPSIA. I would recommend reviewing your inventory just in case the letter wasn't able to reach your inbox. Here's how you can identify affected inventory.

  1. In your seller account, go to your Inventory Amazon Fulfills view.

  2. Click the "Reserved" column heading to sort by that field so that the highest quantities will be on top.

  3. Click the "Show ASIN/FNSKU" check box so you can see the FNSKU for all listings.

  4. Compare the list of FNSKUs below with the FNSKUs of listings with inventory in the Reserved column (all other inventory columns will be 0).

If you use feeds, you can also search your template (or in the Inventory Amazon Fulfills view) for the FNSKUs in the table above.

If you identify any inventory that is restricted, you can complete a removal order (destroy or return to you).

There are supposed to be 2500 ASINs removed and this is a list of only 31 ASINs. How can that be exhaustive, unless the other 2469 ASINs were for products never sent to FBA?

The list above includes only the listings offered by FBA merchants. We could list all 2500 ASINs, but not all of them apply the FBA (and, well, that would be a really big list). So, instead of overwhelming you with more information than you need, we have provided just the information that applies to FBA merchants.

Sorry, this product is ineligible for Amazon Marketplace selling at this time.

Looks like it didn't make the cut...

Could we get this list with descriptions attached? While it helps if you have these items to search for the terms. But if you try to find them now the listing is removed and I don't know what NOT to buy as it is restricted on AZ.

It might be good to return B000NRX5XY to the store, if you are still w/n the return period. I bought some at Target on Black Friday, so I will be stuck with a few. One thing I've noticed:

"The new law requires that domestic manufacturers and importers certify that children’s products made after February 10 meet all the new safety standards and the lead ban. Sellers of used children’s products, such as thrift stores and consignment stores, are not required to certify that those products meet the new lead limits, phthalates standard or new toy standards."

So you can open the box, "test it", and by virtue of having used it, it would be used and legal for sale?
